Learn more about the growing sport and how campuses are managing compliance obligations.
Governance
Esports is currently not governed by the NCAA or other traditional college sports governing bodies. As a result, a few esports leagues and conferences have emerged to provide similar structure and support:
- The National Association of Collegiate Esports (NACE) is the largest member association of varsity esports programs at colleges and universities nationwide. NACE’s constitution and bylaws can be found here.
- Esports Collegiate (ESC) is a governing body for 14 universities located primarily in Ohio, New York, Kentucky, and Indiana.
Title IX
Because esports is viewed as a nontraditional sport, these resources are helpful in evaluating whether esports can count as a sport for Title IX purposes:
- OCR Guidance on Athletic Activities Counted for Title IX Compliance (2008)
- At the preliminary injunction stage, a Middle District of Florida judge ruled that esports is not considered a “sport” for Title IX purposes. Navarro v. Fla. Inst. of Tech., Inc., 2023 WL 2078264 (M.D. Fla. Feb. 17, 2023).
