Kate Davis Provides Insights on the Revocation of 2024 Title IX Regulations

K-12 Education attorney Kate Davis was recently featured in Special Ed Connection®, providing key analysis on the implications of a federal court decision vacating the 2024 Title IX regulations. These regulations, intended to address discrimination based on gender identity and sexual orientation, also introduced specific provisions for handling Title IX investigations involving students with IEPs or Section 504 plans.

On January 9, 2025, U.S. District Judge Danny C. Reeves vacated the regulations in their entirety, effectively reverting districts back to the 2020 Title IX framework. Kate emphasized that the provision specific to students with disabilities is no longer in effect, reminding districts that they must still comply with Title IX, the IDEA and Section 504 in any particular case.  She also reminded districts of their responsibility to continue training multiple administrators to fulfill the various roles in the Title IX grievance process.
