A recent federal court case out of New York included data that employers might find interesting. According to Judge Pauley of the Southern District of New York, “Recent years have witnessed an explosion in FLSA litigation. FLSA cases constitute nearly 9% of the civil cases filed in the Southern District of New York so far this year. And this district is no outlier. Nationwide, annual FLSA filings are up over 400% from 2001.” Judge Pauley attached the following footnote to these stats:
1,961 FLSA cases were filed nationwide in the twelve-month period ending March 31, 2001, compared to 8,126 cases for the twelve-month period ending March 31, 2014. Case filing statistics are available on the Federal Judiciary’s website at http://www.uscourts.gov/statistics-reports/analysis-reports.
